Kai Development ("Kai," "Company," "we," "us," or "our"), operated by Austin Phillips, provides the Kai mobile application, web application, and related services (collectively, the "Service") — an AI-powered music teacher that gets to know each student over time, listens to their playing, and helps them learn and prepare for exams. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. By creating an account or using the Service, you agree to the practices described in this Privacy Policy.

1. Information We Collect
a. Information You Provide to Us
• Account information: name, email address, password, date of birth, and (for parent/guardian accounts) the student's name and age
• Profile and preference information: instrument(s) played, skill level, learning goals, exam track (e.g., ABRSM, Certificate of Merit, RCM), and how you customize Kai's persona (name, tone, and personality settings)
• Payment information: billing details processed by our third-party payment processor for subscription purchases (we do not store full payment card numbers ourselves)
• Communications: messages you send to Kai's conversational interface, support requests, and any feedback you provide
b. Information Collected Automatically
• Audio recordings: with your permission, the Service accesses your device's microphone (or a connected MIDI instrument) to listen to your playing and provide real-time feedback on pitch, rhythm, and timing
• Practice and progress data: session history, practice time, exercises completed, mistakes and improvement patterns, and Kai's long-term memory of your learning journey
• Device and usage information: device type, operating system, app version, IP address, general location (derived from IP address), crash logs, and how you interact with the Service
• Cookies and similar technologies: on our web application, we use cookies and similar tools to keep you logged in, remember preferences, and understand usage patterns
c. Information from Third Parties
• If you sign in using a third-party account (e.g., Google or Apple), we receive basic profile information from that provider as permitted by your settings with them
2. How We Use Your Information
We use the information we collect to:
• Provide, operate, and personalize the Service, including Kai's long-term memory of your progress, goals, and preferences
• Analyze your playing in real time and generate feedback, lesson plans, and exam-prep guidance
• Process subscription payments and manage your account
• Communicate with you about your account, updates, and support requests
• Monitor, maintain, and improve the Service, including troubleshooting and analyzing usage trends
• Detect, investigate, and prevent fraud, abuse, or security incidents
• Comply with legal obligations
3. How We Share Your Information
We do not sell your personal information. We share information only in the following circumstances:
• Service providers: with vendors who help us operate the Service, such as cloud hosting and data storage providers, the AI/language-model providers that power Kai's conversational and audio-feedback engine, payment processors, and customer support tools — each bound by confidentiality and data-protection obligations
• Legal and safety reasons: if required by law, subpoena, or legal process, or where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Kai, our users, or others
• Business transfers: in connection with a merger, acquisition, financing, or sale of assets, in which case we will notify you of any change in ownership or use of your information
• With your consent: for any other purpose disclosed to you at the time we collect the information, or with your explicit consent
4. Data Retention
We retain your account information, progress data, and Kai's memory of your learning journey for as long as your account is active, and for a reasonable period afterward to allow you to resume where you left off if you return. You may request deletion of your account and associated data at any time as described in Section 6 below. We may retain limited information as required for legal, accounting, or security purposes even after account deletion.
5. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
6. Your Rights and Choices
• Access and correction: you can review and update your account and profile information within the app

• Microphone access: you can disable microphone access at any time through your device settings, though this will limit Kai's real-time feedback features
• Marketing communications: you can opt out of promotional emails using the unsubscribe link in those emails
• California residents: under the California Consumer Privacy Act (CCPA), you have the right to know what personal information we collect, request deletion, and opt out of any "sale" or "sharing" of personal information (we do not sell personal information). 7. Third-Party AI Processing
To power Kai's conversational responses and audio feedback, certain information — such as your messages to Kai and short audio samples of your playing — may be processed by third-party AI infrastructure providers under contractual terms that restrict their use of your data to providing the Service to us. We do not permit these providers to use your data to train their own general-purpose models without appropriate safeguards and, where applicable, your consent.
8. Children's Privacy
Kai is designed to be used by music students of many ages, including children, typically with the involvement of a parent, guardian, or music teacher who sets up the account. Where we have actual knowledge that a child under 13 (or the relevant age of consent in your jurisdiction) is using the Service, we limit the collection of personal information from that child to what is reasonably necessary for the Service, and we rely on verifiable parental or guardian consent as required by the Children's Online Privacy Protection Act (COPPA) and similar laws.

9. International Users
The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the app or by email prior to the change becoming effective. The "Last Updated" date at the top of this policy reflects the most recent revision.
